단독]SK하이닉스, 넷리스트와 특허분쟁 사실상 패배…로열티 낸다 유희석 기자 승인 2021.04.06 08:37 [출처 : 비즈니스플러스] [출처 : 비즈니스플러스] SK하이닉스-넷리스트, 크로스라이선스 체결 SK하이닉스가 미국 반도체 기업 넷리스트(Netlist)와 수년간 지속하던 분쟁을 끝냈다. 넷리스트 특허를 인정하고 로열티(특허사용료)를 내기로 한 것. SK하이닉스와 넷리스트는 앞으로 계속 협력을 이어가기로 했다. 6일 반도체 업계에 따르면 SK하이닉스와 넷리스트는 그동안 미국 법원과 특허청에서 진행되던 모든 사건을 종결하기로 합의했다. 또한, 메모리 반도체 기술 등의 크로스라이선스(상호특허협력)를 체결하고, 제품 공급과 기술 협력 계약을 체결했다. 넷리스트는 2000년 미국 얼바인에서 한국인이 설립한 창업한 서버용 메모리 모듈 전문 기업이다. 넷리스트는 2016년 삼성전자와 크로스라이선스를 체결했으나, SK하이닉스와 협상에 실패하자 그해 9월 소송전을 시작했다. 이후 SK하이닉스와 넷리스트는 수년간 법정 공방을 벌였다. 넷리스트는 미국 이외에도 중국과 독일에서도 특허침해 소송을 제기하며 SK하이닉스를 압박했다. 결국, SK하이닉스가 로열티를 내기로 하면서 사실상 넷리스트의 승리로 막을 내리게 됐다. 홍춘기 넷리스트 최고경영자(CEO)는 "넷리시트의 지적재산(IP)의 가치를 인정받을 수 있어 기쁘다"며 "앞으로 메모리 및 저장장치 기술 분야의 글로벌 선두업체인 SK하이닉스와 협력을 기대한다"고 말했다. 그러면서 "SK하이닉스는 앞으로 상용화를 염두에 두고 넷리스트의 HD CXL 기술에 대해 협력할 계획"이라고 전했다. 출처 : 비즈니스플러스

Interesting post in Reddit from someone who heard in that hearing 2days ago:Before call: I tuned in at 4:30 CT (2:30 Pacific); apparently there was another conference before. It was only me and some other guy named Phil at that point. Phil did not know how to mute apparently. The clerk was trying to get him to mute, along with the others that joined the call, but instead someone used the restroom.. flushing, all of it on the call. This is the point she asked everyone to get off and go to the waiting room where she could mass mute us and let us back in when the NLSTGOOG conference started. NOTE.. all of this is paraphrase, based on my 15 years of technical writing experience. It is not official in any way, nor do I assert that I recorded the call verbatim. Words in quotes are verbatim and in appropriate context. I took thorough anecdotal notes and this is my interpretation as a novice in the legal field)
Beginning of call: The clerk started the meeting by indicating that this case has taken an immense amount of time and that Judge Brown would like to know if the parties would be interested in ADR before setting out another year-long schedule of court events. She then went over the advantages of ADR.. fewer court costs, less time, etc.. and seemed to be encouraging the group to consider ADR instead of the whole rigamarole again (I assume the Judge asked her to emphasize this point). Lawyers from both sides indicated that yes, it has been a decade and that there was potential for ADR. Clerk then told them the process for filing for ADR and that they would have 14 days to come back for another CM conference to discuss the ADR.
She then went over dates, reminding them that the text document would supersede any verbally stated dates set forth by the Judge. NLST lawyer then asked if ADR was not a possibility because (my opinion: google dragging it out) they couldn't come to an agreement. If this is the case, can the court intervene/assist? Clerk says yes, a referral to magistrate judge for EARLY DISCOVERY would be appropriate at this time. She described the paperwork involved. (Discovery date as of this conference is 12/17/21, so this would significantly accelerate things if they don't settle). Google lawyer, Dori Hines, quickly responded that Google is "confident" that they can come to an agreement and that they did receive the proposal from Netlist the previous evening.
NLST lawyer quickly responds that they also feel "optimistic" about being able to come to an agreement, however they would like to go ahead and file the paperwork for the magistrate referral because of the "extraordinary" amount of time this case has taken so far. (To me, this indicates NLST putting their foot down). Clerk affirmed and indicated the referral paperwork would be completed and sent tomorrow along with the Judge's dates.
